1. Who we are

This website, nir-yu.com (the “Site”), is operated by INTERNATIONAL CONCIERGE INC DBA NIR-YU (“NirYu,” “we,” “us”). NirYu provides nearshore staffing services that help companies in the United States and Canada build teams across Latin America. For the personal data described in this Policy, NirYu is the party responsible for deciding how and why it is processed (the data controller, or “responsable” under Mexican law).

2. What this Policy covers

This Policy applies to personal information we collect through the Site — including contact and booking forms, downloadable resources, and candidate applications — and through related communications such as email. It does not replace the agreements that govern our services: client engagements are governed by separate written service agreements, and individuals employed or engaged through NirYu receive separate, country-specific privacy notices as part of their employment documentation.

3. What information we collect

3.1 Information you provide

  • Visitors and prospective clients — name, work email, company name, role, phone number, and anything you include in a message when you contact us, book a strategy call, subscribe to updates, or download a guide.
  • Candidates — the information you submit when applying or when we engage with you about an opportunity: resume/CV, employment history, education, certifications, references, language proficiency (including live English assessments, which may be evaluated in real time), compensation expectations, location, and work-eligibility information.

3.2 Information collected automatically

  • Device and usage data — IP address, browser type, device identifiers, pages visited, and referring links, collected through cookies and similar technologies (see Section 8).

We do not intentionally collect sensitive personal data (such as health information, religious beliefs, or biometric data) through the Site, and we ask that you not include it in messages or applications.

4. How we use personal information

  • To respond to inquiries, schedule and hold strategy calls, and deliver resources you request.
  • To provide our staffing services — including evaluating candidates, verifying credentials and references, assessing English proficiency, and presenting candidate profiles to prospective employer clients.
  • To send marketing communications about our services and resources, which you can opt out of at any time using the unsubscribe link or by contacting us.
  • To operate, secure, and improve the Site, including analytics in aggregated or de-identified form.
  • To comply with legal obligations and to establish, exercise, or defend legal claims.

Where required by applicable law, we process personal information on the basis of your consent — which you may withdraw at any time — or as necessary for the purposes described above.

5. How we share personal information

We do not sell personal information, and we do not share it with third parties for their own marketing. We share personal information only as follows:

  • Prospective and actual clients (candidates only). If you apply or engage with us as a candidate, we share your professional profile — resume, assessment outcomes, references, and related information — with clients considering you for a role. This is the core purpose of our service.
  • Service providers that support our operations — website hosting, CRM and email tools, scheduling, analytics, and document management — under obligations to protect the data and use it only on our instructions.
  • Affiliated entities within the NirYu corporate group that help deliver our services across the countries where we operate, under this Policy’s standards.
  • Professional advisors and authorities — lawyers, accountants, auditors, and public authorities where required by law or legal process.
  • Business transfers — in connection with a merger, acquisition, or sale of assets, subject to confidentiality protections.

6. International transfers

We operate across Latin America and serve clients in the United States and Canada, so personal information — particularly candidate profiles — may be transferred to, and processed in, countries other than the one where you live. Where we transfer personal information internationally, we do so in accordance with applicable data protection law and with safeguards designed to protect it to the standards described in this Policy. By submitting your information with this notice available to you, you are informed that such transfers are necessary to provide the services described here.

7. How long we keep personal information

We keep personal information for as long as needed for the purposes described in this Policy, and afterward as required for legal, accounting, or dispute-resolution purposes. Candidate information is retained so we can consider you for future opportunities unless you ask us to delete it, which you may do at any time (Section 9).

8. Cookies and analytics

The Site uses cookies and similar technologies in four categories: necessary cookies that make the Site function, preference cookies that remember your choices, statistics cookies that help us understand aggregate usage, and marketing cookies that measure the effectiveness of our content.

We manage cookie consent through Cookiebot, a consent management platform. On your first visit, a consent banner lets you accept or decline each category individually; only necessary cookies are set without consent, and no statistics or marketing cookies run until you allow them. Cookiebot stores your choice (in a cookie named CookieConsent) so it is honored on later visits.

9. Your rights

You may also withdraw consent, opt out of marketing at any time, and, where local law grants additional rights, exercise those as well; we honor the rights available to you under the law that applies to you.

To exercise any of these rights, contact us at contact@nir-yu.com with your name, the right you wish to exercise, and enough information to locate your data. We will respond within the timeframe required by applicable law and may need to verify your identity first.

10. Security

We use administrative, technical, and physical safeguards appropriate to the nature of the data we handle — including access controls, encrypted transmission, and vendor due diligence. No method of transmission or storage is completely secure, and we cannot guarantee absolute security; if a breach affecting your personal information occurs, we will notify you and the authorities as required by law.

11. Children

The Site is directed at business audiences and working professionals. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us personal information, contact us and we will delete it.

12. Third-party links

The Site links to third-party websites — for example, scheduling tools, social networks, or publications. Their privacy practices are their own; this Policy does not apply to them, and we encourage you to review their notices.

13. Changes to this Policy

We may update this Policy from time to time. The “Last updated” date at the top reflects the current version, and material changes will be highlighted on the Site. Your continued use of the Site after changes take effect constitutes acceptance of the updated Policy where permitted by law.
